SMS Terms of Service

1. Overview and Who These Terms Cover

Digital Macaroni LLC, doing business as RankLadder ("RankLadder," "we," "our," or "us"), sends automated text messages (SMS and MMS) on behalf of businesses that use our AI call answering platform. These messages are transactional follow-ups after a phone call, such as booking confirmations, requested pricing or scheduling information, and appointment reminders.
By opting in to receive text messages from a business that uses RankLadder, you agree to the terms outlined on this page.
Business customers: Section 2 applies to every RankLadder customer that enables or uses SMS, MMS, or another messaging feature. These SMS Terms are incorporated into the main Terms of Service.
Message recipients: Sections 3 through 9 explain consent, frequency, opt-out, privacy, and carrier terms for individuals receiving RankLadder-powered messages.

2. Business Customer Messaging Rules

All messaging sent through RankLadder is treated as application-to-person ("A2P") messaging. Business customers must comply with applicable communications and privacy laws, carrier requirements, the Twilio Acceptable Use Policy, the Twilio Messaging Policy, and these SMS Terms. You are responsible for messages sent by employees, contractors, customers, or anyone else using your account.

2.1 Consent, Identification, and Opt-Out

  • Obtain freely given, informed, and unambiguous consent from each recipient before the first message. Consent must identify the sender and cover the type and purpose of messages you plan to send.
  • Keep reliable consent records and provide them promptly if RankLadder, a carrier, a provider, or a regulator requests them.
  • Reconfirm consent when required by law or provider policy, when a significant amount of time has passed, or when the message purpose materially changes.
  • Clearly identify the business that obtained consent. The initial message must include "Reply STOP to unsubscribe" or equivalent clear one-step instructions.
  • Honor STOP, STOPALL, UNSUBSCRIBE, OPTOUT, CANCEL, END, REVOKE, QUIT, and any other reasonable revocation method required by law. You may send one confirmation, but no additional messages unless the recipient later gives new valid consent.
  • Do not use purchased, rented, scraped, or shared contact lists; send cold or unwanted messages; or send recurring promotional or marketing messages through RankLadder.

2.2 Prohibited Content, Businesses, and Use Cases

Unless RankLadder expressly approves a use in writing after confirming that it is permitted by every applicable provider, carrier, and law, you may not use RankLadder messaging for any of the following. These restrictions may apply to the business itself even if a particular message appears unrelated:
  • High-risk financial services: payday loans, short-term high-interest loans, new-loan solicitation, third-party or affiliate loans, student loans, cryptocurrency, stocks, or investment platforms.
  • Third-party lead generation and marketing: buying, selling, sharing, or brokering consumer information; affiliate lending; affiliate marketing; or deceptive lead-generation and marketing practices.
  • Debt collection, forgiveness, or repair: third-party debt collection, debt consolidation, debt reduction, debt relief or forgiveness, and credit or debt repair programs.
  • Get-rich-quick or deceptive income schemes: deceptive work-from-home programs, high-risk investment opportunities, pyramid schemes, multi-level marketing schemes, and mystery-shopping schemes.
  • Cannabis and other controlled or restricted products: cannabis, marijuana, CBD, kratom, drug paraphernalia, vape products, e-cigarettes, fireworks, or explosives. These restrictions may apply regardless of state legality.
  • Prescription drugs: promoting or selling medication that requires a prescription.
  • Gambling: casinos or casino applications, gambling websites, sweepstakes, raffles, betting, sports picks, or similar wagering activity.
  • SHAFT and adult content: sexual or adult services, hate speech, alcohol, firearms, tobacco, vape products, or e-cigarettes.
  • Fraud, impersonation, and phishing: scams, deceptive account or security alerts, fake delivery notices, impersonation of brands, banks, or government agencies, look-alike or concealed destinations, requests for passwords, PINs, Social Security numbers or similar sensitive information, and simulated phishing or security-testing messages.
  • Academic fraud: essay mills, exam-taking services, ghostwriting intended to evade academic requirements, or unauthorized test materials.
  • Illegal, abusive, or harmful content: unlawful goods or activity; malware, viruses, or malicious links; obscenity; defamation; threats; harassment; exploitation; discriminatory or hateful abuse; content encouraging violence; or content endangering children or others.

2.3 Prohibited Sending Practices

  • Do not send unsolicited or unwanted messages in bulk.
  • Do not spread similar traffic across multiple numbers to evade filtering ("snowshoeing").
  • Do not intentionally misspell words, use non-standard opt-out language, manipulate sender information, or take other steps to evade detection or enforcement.
  • Do not use public or shared URL shorteners, look-alike domains, or obfuscated links. Links must use a destination reasonably identifiable with your business.
  • Do not continue messaging a recipient after consent is revoked, and do not exceed the frequency or scope to which the recipient agreed.
Enforcement: RankLadder may filter or block messages and suspend or terminate messaging access when traffic violates or appears likely to violate these rules, law, or provider or carrier requirements. We will provide notice and a reasonable opportunity to correct an issue when practicable, but may act immediately to prevent harm or comply with a third-party requirement.
Fines and costs: Carrier, provider, and regulatory penalties arising from your traffic are your responsibility and may be passed through as described in Section 5.1 of the main Terms of Service.
Current provider rules control: This list is intentionally detailed but cannot anticipate every prohibited use or later carrier change. A use prohibited by applicable law, carrier rules, or Twilio's current policies is prohibited even if it is not named above.

4. Message Frequency

Message frequency varies. Typically, you will receive one to a few text messages per call (for example, a booking confirmation and a reminder). Messages are sent only in connection with a call you made to the business. You will not receive recurring promotional or marketing messages.

5. Message & Data Rates

Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan and any charges that may apply. RankLadder does not charge you for receiving text messages, but your carrier may.

6. Opt-Out (STOP)

You can stop receiving SMS messages at any time by replying STOP to any message you have received from us. After sending STOP, you will receive a one-time confirmation message and will no longer receive SMS messages from that sender.

8. Mobile Data Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
All text messaging originator opt-in data and consent information will not be shared with any third parties. We collect phone numbers solely for the purpose of sending service-related text messages (booking confirmations, requested information, appointment reminders) on behalf of the business you called.

9. Carrier Disclaimer

Messages are transmitted through third-party mobile network providers. Carriers are not liable for delayed or undelivered messages. We do not guarantee that messages will be successfully transmitted to every recipient.
Supported carriers include, but are not limited to: AT&T, Verizon, T-Mobile, and other major U.S. wireless providers. Carrier support is subject to change without notice.
